LIMITED WARRANTY

SafePro Safety Products (“SafePro”) warrants to the original purchaser who owns the building on which the SAFEPRO® product identified above is installed that the product will be free from defects in materials and workmanship from the date of installation through the applicable period specified in the Warranty Coverage Tables below, provided that the product is properly used, inspected, and maintained in accordance with SafePro’s instructions and recommendations.

This warranty does not cover damage or defects resulting from acts of God, vandalism, neglect, improper use, improper maintenance, faulty installation, or any other cause outside SafePro’s reasonable control. THE WARRANTIES SET FORTH HEREIN ARE MADE IN LIEU OF ALL OTHER WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING THE IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE.

To maintain this warranty, the building owner or its authorized agent must:

1. Arrange for the SAFEPRO® product identified above to be inspected at least semi-annually, including checking frame alignment, tightening all nuts and bolts, and greasing hinges where appropriate;

2. Maintain a written log documenting all inspections and maintenance; and

3. Notify SafePro before installing or using the product in an aggressive environment, including, without limitation, locations near chemicals, swimming pools, exhaust vents, coastal environments, excessive heat, or temperatures outside the range of -30°C (-22°F) to 50°C (122°F). SafePro will confirm in writing the extent, if any, to which this warranty will apply under such conditions.

SafePro will be released from all obligations under this warranty if any of the above requirements have not been fully satisfied or if the SAFEPRO® product identified above, or any component associated with it:

1. Has been used or operated inconsistently with SafePro’s instructions;

2. Has been used or operated inconsistently with its intended purpose;

3. Has been modified or repaired by anyone other than SafePro or a SafePro-authorized agent; or

4. Has been damaged as a result of misuse, abuse, neglect, improper maintenance, or improper installation.

CLAIMS AND LIMITED REMEDIES

Claims must be submitted in writing, together with photographs documenting the potential defect, within thirty (30) days after the defect is first observed. Claims should be submitted to SafePro Safety Products, 739 Moore Road, Cleveland, OH 44012.

The Limited Warranty holder must permit SafePro or its authorized agents to inspect any claimed defect and must provide SafePro or its authorized agents with all requested installation reports, inspection records, maintenance logs, photographs, and other documentation relevant to the claim.

If SafePro, in its sole discretion, approves a claim covered by this Limited Warranty, SafePro’s sole obligation will be to repair or replace the defective item with an item of comparable value, to the extent commercially reasonable. THE FOREGOING WILL CONSTITUTE THE EXCLUSIVE REMEDY AVAILABLE UNDER THIS LIMITED WARRANTY.

SAFEPRO’S LIABILITY IS LIMITED TO THE REMEDIES DESCRIBED ABOVE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SAFEPRO WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING, WITHOUT LIMITATION, ECONOMIC LOSS, LOSS OF PROFITS, LOSS OF USE, OR ANY OTHER DAMAGES OF ANY KIND WHATSOEVER. THIS LIMITATION APPLIES TO CLAIMS ARISING FROM BREACH OF WARRANTY, TORTIOUS CONDUCT, OR ANY OTHER CAUSE OF ACTION ASSERTED AGAINST SAFEPRO.

LIMITATIONS

This Limited Warranty is issued exclusively by SafePro Safety Products to the owner of the building on which the SAFEPRO® product identified above is installed. It may not be transferred or assigned to another person or entity without SafePro’s prior written consent.
