LIMITED WARRANTY

Rooftop Anchor, Inc. (“RTA”) warrants to the original purchaser who owns the building on which the SAFEPRO® brand product identified above is installed, that such product shall be free from defects in material and workmanship from the date of installation through the period of time specified in the Warranty Coverage Tables below if properly used, inspected, and maintained in accordance with RTA’s instructions and/or recommendations. This warranty does not cover Acts of God, vandalism, neglect, improper use, or faulty installation. THE WARRANTIES SET FORTH HEREIN ARE MADE IN LIEU OF ALL OTHER WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING THE IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE.

To maintain this warranty, the building owner or its agent must:

1. Arrange for the SAFEPRO® brand product identified above to be inspected at least semi-annually to check proper frame alignment, tighten all nuts and bolts, and to grease hinges appropriately;

2. Keep a log of such maintenance; and

3. Notify RTA where it is proposed that the SAFEPRO® brand product identified above may be used in an aggressive environment, such as (without limitation) anywhere near chemicals, excessive heat (greater than 50° C (120° F), outside the temperature range of <-30° C (-22°F) or >50°C (122°F), near swimming pools, near exhaust vents and in coastal locations. RTA will confirm in writing the extent, if any, to which this guarantee will apply in such circumstances.

RTA shall be immediately released from all obligations under this warranty in the event any of the above requirements have not been fully satisfied or if the SAFEPRO® brand product identified above, or any component related thereto:

1. Has been used or operated inconsistent with RTA’s instructions; or

2. Has been used or operated inconsistent with its intended use; or

3. Has been modified or repaired by anyone other than RTA or its authorized agent; or

4. Has been damaged because of misuse or neglect.

CLAIMS AND LIMITED REMEDIES: Claims must be submitted in writing with pictures within thirty (30) days of observance of any potential defects to Rooftop Anchor, Inc., 844 South 430 West, Ste. 200, Heber City, UT 84032. The Limited Warranty holder must permit RTA or its agents to inspect any potential defect and must provide RTA or its agents with any installation reports, maintenance logs, or other documentation with respect to any claim under the Limited Warranty. If RTA, in its sole discretion, approves a claim covered under the Limited Warranty, RTA’s sole obligation will be to repair or replace defective items with items of comparable value to the extent commercially reasonable. THE FOREGOING WILL CONSTITUTE THE EXCLUSIVE REMEDY FOR THE LIMITED WARRANTY. LIABILITY OF RTA IS LIMITED TO THE ABOVE, AND IN NO EVENT WILL RTA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING WITHOUT LIMITATION ECONOMIC, LOSS OF PROFITS, OR OTHER DAMAGES OF ANY KIND WHATSOEVER. This provision is applicable to claims for breach of warranty, tortious conduct, or any other cause of action asserted against RTA.

LIMITATIONS. This warranty is expressly given to the owner of the building on which SAFEPRO® brand product identified above is installed and may not be transferred or assigned to any other person or entity without prior written consent from RTA.
